01About this licence
This licence is the agreement between you and [Company name] (company number [number]), registered at [registered address], for using the Packed Out app. It covers the app at app.packedout.co.uk and the app saved to your phone’s home screen. It also covers the emails and links we send you from it.
Our Terms cover bookings, payments and cancellations. Our Privacy policy covers your information. This licence covers using the app itself. All three apply together.
By creating an account or using the app, you agree to this licence. If you don’t agree, please don’t use the app.
02Words we use
- The app means the Packed Out web app, every version of it and anything we add to it.
- You means the person using the app, or the venue or business they use it for.
- Your content means anything you add to the app: photos, videos, links, descriptions, prices, messages, notes and reviews.
- We and us mean Packed Out.
03What you can do
We give you permission to use the app to book acts, or to be booked, through Packed Out. This permission is personal to you. You can’t sell it or pass it on. We can withdraw it as set out below.
The app is licensed to you, not sold. We own the app, its design, its code and the Packed Out name and logo.
04What you mustn’t do
- Copy, sell, rent or give access to the app, or any part of it, to anyone else.
- Use bots, scrapers or anything automatic to collect information from the app, including other people’s details or prices.
- Take apart, reverse engineer or try to get the app’s code.
- Try to get round its security, or test it for weaknesses, without our written permission.
- Share your login with anyone outside your venue or act.
- Use the app to find acts or venues and then book them outside Packed Out to avoid our fee. Our Terms explain what happens if you do.
- Remove or hide our name, logo or copyright notices.
05Your account
You must be 18 or over to have an account. Keep your login safe. You’re responsible for everything done through your account. If you think someone else has used it, email support@packedout.co.uk straight away.
06Your content
Your content stays yours. You let us show it on Packed Out so venues and acts can see it. You also let us use it to promote your page on Packed Out. This permission ends when you remove the content or close your account, apart from copies we’ve already shared or need to keep by law.
You must have the right to everything you add. That includes photos of other people and music in your videos.
You mustn’t add anything that is:
- against the law, or encourages something that is
- offensive, threatening, discriminatory or abusive
- false or misleading, including fake reviews or prices you won’t honour
- someone else’s work, name or brand without their permission
- someone else’s personal details
- spam, adverts for other services or anything harmful such as a virus
We can change how your content is laid out. We can remove anything that breaks this licence. We can also suspend an account that keeps breaking it.
07Reviews
Reviews must be honest and about a booking that really happened through Packed Out. We can remove a review that is abusive, false or not about the booking.
08Other services
Parts of the app use other companies. Stripe takes payments and pays acts. Links can open Google Calendar, Instagram, TikTok, Facebook, YouTube and maps. Their own terms apply when you use them. We aren’t responsible for their services.
09Changes to the app
We keep improving the app. We can add, change, pause or remove features at any time. Sometimes the app will be unavailable while we work on it. We’ll tell you in advance about big changes that affect how you use it.
10Keeping the app running
We work hard to keep the app running and secure, but we can’t promise it will always be available or free of mistakes. Keep your own copies of anything important. Packed Out doesn’t promise any number of bookings.
11Our responsibility to you
Nothing in this licence limits our responsibility for death or personal injury caused by our negligence, for fraud, or for anything else the law doesn’t let us limit.
Venues and acts use Packed Out for their business. We aren’t responsible for lost profits, lost income, lost data or other business losses caused by using the app or not being able to use it.
Otherwise, our total responsibility to you for using the app is limited to [the booking fees you’ve paid us in the 12 months before the claim, or £100 if that is more].
12Ending this licence
You can stop using the app at any time. To close your account, email support@packedout.co.uk.
We can suspend or end your access if you break this licence or our Terms. Where we reasonably can, we’ll tell you first and give you a chance to put it right.
When your access ends, you must stop using the app. Anything owed for bookings already made is still owed.
13Changes to this licence
We may update this licence. If a change matters, we’ll email you or tell you in the app at least 30 days before it applies. If you keep using the app after that, you agree to the new version.
14The legal bits
- If part of this licence can’t be enforced, the rest still applies.
- If we don’t enforce a right straight away, we can still enforce it later.
- This licence, our Terms and our Privacy policy are the whole agreement between us about the app.
- The law of England and Wales applies. Any dispute goes to the courts of England and Wales.
